Acceptance of These Terms
These Terms & Conditions are an agreement between you and The Golf Engineer ("TGE", "we", "us"), covering thegolfengineer.com and the guides, tools, content, and accounts we offer through it (together, the "Service").
By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please don't use the Service.
Age Requirement and Children's Protections
You must be at least 13 years old to use the Service and to create an account. The Service is not directed to children under 13, and we do not knowingly collect personal information from them. This is the same minimum stated in our Privacy Policy.
By using the Service you confirm you are 13 or older. If you are between 13 and the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Parents and guardians. If you believe a child under 13 has created an account or given us personal information, email [email protected]. We will look into it, delete the information, and close the account. You do not need an account to make that request, and we will not ask you for more information than we need to act on it.
How we protect younger users. We do not serve behavioural or targeted advertising to any user of any age, and we do not sell or share anyone's personal information. We offer no public profiles, no direct messaging, and no open comments, so users cannot contact each other through the Service. And we do not ask for more personal information than is needed to create an account and save your own work.
If we later add features that change any of this (community features, for example), we will update these Terms and the Privacy Policy before those features launch, and assess whether verifiable parental consent obligations apply under the Children's Online Privacy Protection Act.
Your Account
You may create an account with an email address and password, or by signing in with Google. You are responsible for keeping your credentials confidential and for what happens under your account. Please provide accurate information and keep it current, use one account per person, and don't share or transfer it.
Tell us promptly at [email protected] if you suspect unauthorised use. You can delete your account at any time from your account page; what that does with your data is described in our Privacy Policy.
Acceptable Use
Please don't use the Service to break the law or infringe anyone's rights. Specifically, don't scrape, crawl, harvest, or bulk-download our content, data, or images except as our robots.txt permits or with our written permission; don't reverse engineer or attempt to extract the source of the Service, except where that restriction is prohibited by law; don't probe or test its security, or circumvent any authentication; don't interfere with its operation through excessive automated requests, denial-of-service attempts, or malware; don't access another user's account or data; and don't impersonate anyone or misrepresent your affiliation.
Please also don't use the Service to build a competing product, or to train a machine learning model on our content, without our written permission.
If you think you have found a security vulnerability, report it to [email protected] rather than exploiting it. We appreciate good-faith reports and will not pursue action against researchers who act responsibly and give us reasonable time to fix the issue.
Your Content
"Your Content" means anything you save to the Service: the clubs and carry distances in your saved bags, your gear comparisons and combo sets, and the values you enter into the tools.
You own Your Content. We claim no ownership of it. You grant us a limited, non-exclusive, royalty-free licence to store, process, and display it solely to operate the Service for you, and that licence ends when you delete the content or your account.
We may use aggregated, de-identified information about how the Service is used to improve it and to inform our editorial research. Aggregated data does not identify you and is not Your Content.
Please keep your own copies of anything important. We are not a backup service.
Guides, Tools, and Recommendations
TGE publishes equipment research and provides calculators such as the Gapping Tool and the Wedge Matrix. These are informational aids, not a fitting service.
Their output depends entirely on the values you enter and on general assumptions about ball flight; they are estimates, not measurements of your game. Equipment specifications, availability, and pricing change frequently and may be out of date or wrong; verify with the manufacturer or a fitter before buying anything.
Nothing on the Service is professional instruction, fitting advice, medical advice, or a guarantee of performance. Decisions about your equipment or your swing are yours.
We are not affiliated with, endorsed by, or sponsored by any equipment manufacturer. Brand and product names are used descriptively and remain the property of their owners. Product images are used for editorial purposes and remain the property of their respective manufacturers.
Our Intellectual Property
The Service, including our articles, reviews, data compilations, tools, design, and code, is owned by TGE and protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial use. That licence covers only the material we own.
Product images and brand names are not ours. Equipment photography, logos, and trademarks belong to their respective manufacturers and owners. We use them for editorial identification and commentary, we claim no rights in them, and nothing in these Terms grants you any right to them. If you own such material and want it removed or credited differently, email [email protected] and we will act on it.
You may quote brief excerpts of our written content with attribution and a link. Please don't republish, redistribute, or create derivative works from substantial portions of it without written permission.
If you believe content on the Service infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to [email protected], including identification of the work, where it appears on our site, your contact information, and a statement of good-faith belief made under penalty of perjury.
Third-Party Services and Links
The Service links to third-party websites and relies on third-party providers for hosting, database, analytics, email, and Google sign-in. We don't control third-party sites and aren't responsible for their content, products, or privacy practices. If you use Google sign-in, Google's own terms and privacy policy also apply.
Buying from a retailer we link to. Some links on the Service, including the "Shop" links on our gear guides, go to third-party retailers such as 2nd Swing. Any purchase you make there is between you and that retailer. We are not the seller, we are not a party to the transaction, and we make no promise about a product's condition, price, availability, shipping, or fit for your game. Returns, refunds, warranty claims, and disputes about an order are handled by the retailer under its own terms and policies.
Affiliate Links
The Service participates in the Awin affiliate network with 2nd Swing. "Shop" links on the gear guides are affiliate links: if you buy something after following one, we may earn a commission at no extra cost to you.
This relationship does not affect which clubs appear in the guides, how they are ranked or described, or the output of any tool. We link to a retailer because it stocks the club, not because of the commission. Each guide that carries these links says so on the page, and our Privacy Policy describes what is and is not recorded when you click one.
Availability and Changes
We may modify, suspend, or discontinue any part of the Service at any time, including features you rely on. Where a feature stores your content, we will try to give reasonable notice before removing it so you have a chance to export your work. The Service is provided without any uptime commitment.
Termination
You may stop using the Service and delete your account at any time. We may suspend or close your account if you materially breach these Terms, if the law requires it, or if your use puts the Service or other users at risk. Where it is practical and lawful to do so, we will tell you why. The sections on Your Content, intellectual property, disclaimers, liability, indemnification, and governing law survive termination.
Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content, specification, or calculation is accurate or current. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, TGE will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or purchases made in reliance on the Service, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars ($100.00), or the amount you paid us in the twelve months before the claim, whichever is greater.
Some jurisdictions do not allow the limitation of certain damages, so parts of this section may not apply to you. Nothing here limits liability for fraud, gross negligence, or wilful misconduct where that limitation is prohibited by law.
Indemnification
You agree to indemnify and hold harmless TGE from any claims, damages, losses, and reasonable legal fees arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right. We will notify you of any such claim and may take part in its defence at our own expense.
Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and TGE agree to the exclusive jurisdiction of the state and federal courts located in San Diego County, California for any dispute not suitable for small-claims court, and each of us waives any objection to venue there.
Before filing a claim, we each agree to try to resolve the dispute informally by contacting the other and allowing 30 days to work it out. Either of us may still bring an individual claim in small-claims court if it qualifies.
Changes to These Terms
We may update these Terms as the Service evolves. We will revise the effective date above, and for material changes we will give notice on the site or by email to account holders before they take effect. Continuing to use the Service after that date means you accept the updated Terms; if you don't, you can delete your account.
General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and TGE regarding the Service.
Severability. If any provision is found unenforceable, the rest stays in effect and that provision is modified only as far as necessary.
No waiver. If we don't enforce a provision, that isn't a waiver of it.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. These Terms create no rights in anyone other than you and TGE.
